HASS AVOCADO BOARD CINCO DE MAYO SWEEPSTAKES
RULES AND REGULATIONS
(1) Description of Sweepstakes:
The Hass Avocado Board (the "Sponsor") is offering the "Cinco de Mayo Sweepstakes" (the "Sweepstakes") and will award prizes via a random selection of valid entrants. The Sweepstakes begins at midnight April 24, 2007 Pacific Time (PT) and ends May 7, 2007 at midnight PT, ("Sweepstakes Period").
(2) How to Enter: No Purchase Necessary.
Visit www.avocadocentral.com and complete the registration form with your first name, last name, street address, city, state, zip code, telephone number and email address. You will have the opportunity to refer up to ten (10) friends by providing their email addresses. For each valid email address to which you send a referral email, you will receive one (1) additional entry in the Sweepstakes. There is a limit of one (1) original entry per person per email address with the possibility to earn up to ten (10) additional referral entries. You will be given the opportunity to subscribe to the recipe e-newsletter, however subscribing to the e-newsletter is NOT a requirement for Sweepstakes entry, nor does it increase your chances of winning. By subscribing to the e-newsletter, entrants understand their entry information will be used by the Sponsor for subsequent marketing and communication efforts.
(3) Eligibility:
The Sweepstakes is open to legal residents of the (50) United States and the District of Columbia who are 18 years of age or older. Sweepstakes is void where prohibited by law. If the age of majority in your jurisdiction is older than 18, you must be the age of majority in your jurisdiction to be eligible. Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of the Hass Avocado Board, its affiliated boards/commission, companies, and advertising and promotion agencies, and any other company involved in the design, execution or production of this Sweepstakes are not eligible.
(4) Prizes:
Grand Prize - One (1) verified winner will receive a three (3) day/two (2) night trip for four (4) people to Las Vegas, NV ("Getaway Prize"). Getaway Prize includes roundtrip coach airfare for four (4) people from the major metropolitan airport nearest the winner's home to Las Vegas, NV, two (2) standard rooms for two (2) nights each based on double occupancy at the Mandalay Bay Resort and Casino, Las Vegas, NV a celebrity chef sponsored dinner for four (4) people at the Border Grill, Las Vegas NV, and a set of three (3) cookbooks from the Border Girls. The approximate retail value of the prize is $2,000. Verified winner will have his/her choice of receiving the Getaway Prize as described above, or a one-time cash payment of $1,000. Getaway Prize does not include transportation to/from the airports of departure or arrival. The Getaway Prize is available on the dates identified by the Sponsor at the time of prize award and all four individuals must travel on the same itinerary. If the Grand Prize accepts the Getaway Prize on the dates offered and he/she cannot complete the travel on the dates scheduled for any reason, prize will be forfeited and the Sponsor will have no further obligation to winner. Winner's travel companions must be of the legal age of majority in their state of residence (and at least 18 years of age). If winner resides within a 100-mile radius of Las Vegas, NV, Sponsor reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Certain travel restrictions may apply. Winner is solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, ground transportation, gas, meals, gratuities, and souvenirs. Winner's traveling companions must execute and return a liability/publicity release prior to issuance of travel documents. Getaway Prize is not transferable and there are no variations or substitutions available other than the cash option described in these Official Contest Rules. In the event of unavailability of accommodations at the Mandalay Bay Resort and Casino, Sponsor reserves the right to substitute hotel accommodations of equal or greater value. All federal, state and local taxes and any costs and expenses related to the acceptance and use of a prize not specified herein are the responsibility solely of the winner.
First Prize - Nine (9) first prize winners will each receive one (1) set of three (3) Border Grill cookbooks, ARV $30. There are a total of ten (10) prizes with a total approximate retail value of all prizes of $2,900. The odds of winning depend upon the number of valid entries received.
(5) General:
A random drawing will be conducted on or about May 10, 2007 and winners will be contacted within five (5) business days of the drawing. Potential Grand Prize winner will be required to complete an Affidavit of Eligibility and a Liability/Publicity Release (unless prohibited by law). The Affidavit, and Liability/Publicity Release must be returned within ten (10) days of receipt of these documents. Potential winner will also be required to send a copy of his/her passport, driver's license, birth certificate or other appropriate documentation (acceptable to Sponsor) as proof of age and residency. Non-compliance with any of these requirements will result in disqualification, in which case an alternate winner will be chosen. Return of prize notification and/or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected. Grand Prize winner's traveling companions will be required to complete and return a liability/publicity release prior to the issuance of travel documents.
First place winners will be notified by phone, mail or email to confirm acceptance of the prize and to verify the shipping address for the prize. Potential winner must respond within five (5) days of first attempted notification or at Sponsor's discretion he/she will be disqualified and an alternate winner will be selected.
By accepting a prize, a winner agrees to allow use of his or her name, location (city only), voice, statements and/or photo for advertising this or similar promotions without limitation and without compensation, except where prohibited. ALL TAXES ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Prizes are not exchangeable, transferable and there are no cash substitutions except as described for the Grand Prize above. By participating, entrants agree to be bound by these rules and the decision of the Sponsor as final in all matters relating to the Sweepstakes. Sponsor is not responsible for any electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction, and virus distribution or by a human error which may occur in the process of recording on-line entries at the web page. Sponsor is not responsible for any damage to an entrant's computer hardware or software that may occur as a result of entrant participating in the Sweepstakes. Any attempt by an entrant to interfere with the operations of the Sweepstakes is a violation of criminal and civil laws; Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law. In the event of a dispute regarding who submitted an on line entry, the entry will be deemed submitted by the holder of the email account. If, in Sponsor's opinion, there is any suspected or actual tampering with any portion of the Sweepstakes, or if technical or other difficulties outside of Sponsor's control compromise the integrity of the Sweepstakes, Sponsor reserves the right to terminate the Sweepstakes and in such event to select winners through a random drawing from among all valid entries received before such termination. All entries are the property of the Sponsor.
(6) Release:
BY ENTERING THE SWEEPSTAKES, PARTICIPANTS RELEASE AND HOLD SPONSOR AND THE CALIFORNIA AVOCADO COMMISSION AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES OF SPONSOR AND THE CALIFORNIA AVOCADO COMMISSION, HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE SWEEPSTAKES OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR DEFECTS IN, A PRIZE, OR PARTICIPATION IN THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION CLAIMS BASED ON PERSONAL INJURY, DEATH, PROPERTY LOSS OR DAMAGE, PUBLICITY OR PRIVACY RIGHTS, AND/OR DEFAMATION.
(7) Winners List Request:
Confirmed winners will be announced at www.avocadocentral.com approximately three (3) weeks after the end of the Sweepstakes.
